Terms of Service for SnapGo-AI

Welcome to SnapGo-AI! These Terms of Service ("Terms") govern your use of the SnapGo-AI macOS application, our websites, and any related services (collectively, the "Service"), operated by GradInnovate Inc. ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Agreement to Terms

By using our Service, you confirm that you are at least 13 years of age and agree to these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms.

2. Privacy Policy

Your privacy is critically important to us. Our Privacy Policy explains how we collect, use, and share your personal information. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy, which is incorporated by reference into these Terms. Please read it carefully.

3. Changes to Terms or Services

We may modify these Terms at any time. If we make material changes, we will notify you, for example, by posting a notice within the application or by sending you an email. Your continued use of the Service after the changes have been implemented will constitute your acceptance of the new Terms. We may also change or discontinue all or any part of the Service, at any time and without notice, at our sole discretion.

4. Subscriptions and Billing

a. Free Usage

SnapGo-AI offers a limited number of free captures (the "Free Tier") to allow you to experience the Service before subscribing. Currently, this is limited to 20 captures. We reserve the right to change the limits and features of the Free Tier at any time.

b. Paid Subscriptions ("SnapGo-AI Pro")

For unlimited access to all features, you must purchase a subscription to SnapGo-AI Pro. Subscriptions are available on a monthly or yearly basis.

c. Billing, Cancellation, and Refunds

All payments, billing, and subscription management are handled directly by Apple through their In-App Purchase system via the Mac App Store.

  • Billing: You will be billed in advance on a recurring and periodic basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Your cancellation will take effect at the end of the current billing period.
  • Refunds: Any refund requests are subject to the terms and conditions of the Apple App Store. We do not have the ability to manage or issue refunds directly.

5. User Content

"Content" means any information, text, graphics, or other materials that you capture, paste, or otherwise provide to the Service.

  • You Own Your Content: You retain all ownership rights to your Content. These Terms do not grant us any licenses or rights to your Content except for the limited rights needed to operate the Service.
  • Our License to You: We grant you a limited, non-exclusive, non-transferable license to use the Service.
  • Our License from You: To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store your Content. This license is solely for the purpose of providing and improving the Service. For example, we need this license to send your Content to our AI service for analysis and return the result to you.
  • Privacy of Content: As stated in our Privacy Policy, your database is stored locally on your device. When AI analysis is required, we transmit the content anonymously to our servers. We have no way of linking specific content back to a specific user.

6. AI Services

Our Service uses artificial intelligence to analyze and categorize your Content.

  • No Guarantee of Accuracy: You acknowledge that the output generated by AI services may not always be 100% accurate or complete. You should not rely on the AI-generated output without independently verifying its accuracy.
  • No Liability: We are not liable for any errors, omissions, or inaccuracies in the AI-generated content or for any actions you take based on that output.

7. Acceptable Use

You agree not to misuse the Service. For example, you must not, and must not attempt to, do the following:

  • Use the Service for any unlawful purpose or for promotion of illegal activities.
  • Probe, scan, or test the vulnerability of any system or network.
  • Breach or otherwise circumvent any security or authentication measures.
  • Reverse-engineer or decompile the Service, or try to access the source code.
  • Interfere with or disrupt any user, host, or network.

8. Termination

You are free to stop using our Service at any time. We also reserve the right to suspend or terminate your access to the Service with or without notice if:

  • You are in breach of these Terms.
  • Your use of the Service would cause a real risk of harm or loss to us or other users.

9. Disclaimers

The Service is provided "AS IS," at your own risk, without express or implied warranty or condition of any kind. We also disclaim any warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SnapGo-AI INC., ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

11. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles.
